These Terms of Service set out the agreement between you and AcneAway, Inc. for the use of the website at https://www.acneaway.lol and for the compounding services of the practice at 800 3RD Ave Frnt A1535, New York - 10022-7649, United States (US). By using the website or engaging a service, you accept these terms. Please read them carefully before you proceed.
Acceptance of these terms
By visiting the website, by sending a message to AcneAway, Inc. or by engaging any of the services described here, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the website or the services.
These terms apply together with our Privacy Policy, which explains how personal information is handled, and with any written plan or program document that the practice provides for a specific service. Where a written plan or program document conflicts with these terms, the specific document governs for that service.
Eligibility and capacity
To engage the services of AcneAway, Inc., you must be able to enter into a binding agreement or must do so through a parent, a guardian or another person with lawful authority. Where a client is under eighteen, a parent or guardian takes part in the arrangement and accepts these terms on the younger client behalf.
By using the website and the services, you confirm that the information you provide is accurate, that you are entitled to provide it and that you will keep it current. If you act for an organization such as a school or a club, you confirm that you are authorised to accept these terms on its behalf.
Description of services
AcneAway, Inc. provides a set of compounding services for young skin. These are skin assessment and grading, personal treatment planning, daily care kits, progress review visits, school and sports skin programs, and home routine guidance. Each service is described in more detail on the services page of the website.
The practice grades skin, blends a daily routine, prepares measured kits and reviews progress on a schedule. The services are provided by trained staff at the New York bench, and the exact content of a service is set out in the plan or program document prepared for each case. We may improve, adjust or withdraw a service from time to time, and we will describe any significant change before it affects an active arrangement.
Not a substitute for medical care
The services of AcneAway, Inc. are supportive, routine based and educational. They are not medical diagnosis, medical treatment or a substitute for the advice of a physician, a dermatologist or another qualified medical professional.
If you have a medical concern, if skin is painful, rapidly worsening, bleeding, infected, or if you are unsure whether a condition is suitable for our bench, please consult a qualified medical professional first. Our staff will say plainly when a case belongs with a medical specialist, and nothing in these terms limits your right to seek medical care at any time. In an emergency, contact emergency services immediately rather than the bench.
Appointments and scheduling
Appointments for assessment, review and program sessions are arranged in advance, and each is reserved for one case so that the bench can prepare properly. Please arrive on time and bring the information confirmed with your booking, such as a list of products currently in use and any notes you wish us to see.
Appointments are confirmed when we have agreed a date and time with you. If you need to change an appointment, please let us know as early as you can so the slot can be offered to another client. Repeated missed appointments may affect the availability of future booking slots and may carry the fees described in the section on cancellation.
Your responsibilities
To use our services well, you agree to provide accurate and complete information about the skin and the routine currently in use, to tell us about any product, treatment or medical condition that may be relevant, and to follow the written plan that we agree together.
You agree not to misuse the website or the services, not to attempt to interfere with the security or the operation of the website, and not to present our written material as your own or as the work of another practice. You agree to use the daily care kit as directed, to keep the sealed crocks clean and closed and to tell us promptly if skin reacts unexpectedly so the routine can be reviewed.
Daily care kits and refills
Daily care kits are prepared in measured portions and handed over in sealed crocks with a labelled schedule card. The kit is blended for the individual case and for the schedule agreed at the bench, and it is intended for that client only.
Please do not share a kit with another person, add steps that were not agreed, or use a kit beyond the period set out on the schedule card. Refills are prepared at review visits or on request, and the practice will explain how to arrange a refill and how long a measured portion is expected to last. If a kit is stored incorrectly or kept past its stated period, the routine may not hold as intended and a fresh blend should be requested.
School and sports programs
School and sports skin programs are arranged with an organization, and the organization is responsible for obtaining any consent that its own rules and the law require from participants and their families before the program begins. The organization is also responsible for providing a suitable space and for coordinating participants on the agreed dates.
Individual records created during a program belong to the same careful system as every other client record and are not shared with coaches, teachers or other participants. Where an organization requests a summary, that summary describes the program as a whole and does not identify an individual participant. Programs may be adjusted if the number of participants or the schedule changes, and any change to a fee will be agreed in writing before it applies.
Fees and payment
Fees for services are set out in the plan or program document prepared for each case, or are quoted when an appointment is arranged. Fees are payable in the manner stated at the time of booking, and any applicable taxes are added where the law requires.
Prices may change from time to time, and a change will not apply to a service already confirmed unless the change is agreed with you in writing. Payment details are handled through a payment provider, and we do not store full payment credentials at the bench. If a payment is not made as agreed, we may pause a service or a refill until the matter is resolved.
Cancellation and rescheduling
You may cancel or reschedule an appointment by writing to help@acneaway.lol or by calling +16625869753. Please give as much notice as you can. A cancellation made with reasonable notice carries no charge, while a cancellation made very close to the agreed time may carry a fee because the slot cannot be offered to another client.
If AcneAway, Inc. must cancel or reschedule an appointment, we will offer a new time as soon as possible and any fee already paid for the cancelled appointment will be applied to the new booking or refunded. Where a program is cancelled by the organization, the fee arrangement is set out in the program document.
Acceptable use of the website
The website is provided so that visitors can learn about the practice and reach the bench. You agree to use it only for lawful purposes and in a way that does not harm the website, its host or another visitor.
You agree not to attempt to gain unauthorised access to any part of the website, not to introduce malicious code, not to scrape content at a volume that places an unreasonable load on the service, and not to use the website to send unlawful, misleading or abusive material. Where you submit content through the contact form, you confirm that the content is accurate and that you have the right to send it. We may investigate misuse and may report it to the relevant authority.
Intellectual property
The content of the website, including its text, its layout, its visual design and its name and marks, is owned by AcneAway, Inc. or is used with permission, and it is protected by copyright and other laws. The written plans, grade records and program materials that we prepare are provided for the use of the client for whom they were made.
You may view and print a reasonable amount of the website content for your own personal and non commercial use. You may not copy, republish, sell or redistribute the content, or use the name or the marks of AcneAway, Inc., without our prior written permission. Nothing in these terms transfers any intellectual property right to you.
Disclaimer of warranties
The website and the services are provided on an as available basis. While we work carefully and keep our methods in order, we cannot promise that the website will always be available, free of interruption or free of error, nor can we promise a particular outcome for any individual skin.
To the fullest extent permitted by law, AcneAway, Inc. disclaims all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non infringement. Nothing in these terms excludes a warranty or a right that the law does not allow to be excluded, and nothing here limits your right to seek medical care.
Limitation of liability
To the fullest extent permitted by law, AcneAway, Inc. and its staff will not be liable for any indirect, incidental, special or consequential loss arising from the use of the website or the services, including loss of profit, loss of data or interruption of a routine.
Where liability cannot be excluded, our total liability for a claim relating to a service will not exceed the fee paid for that service. Nothing in these terms limits liability that the law does not allow to be limited, including liability for fraud, for personal injury caused by negligence where the law does not permit an exclusion, or for any other matter that cannot lawfully be excluded.
Indemnity
You agree to indemnify AcneAway, Inc. and its staff against any claim, loss or expense that arises from your breach of these terms, from your misuse of the website or the services, or from content that you submit through the contact form that is unlawful or that infringes the rights of another.
This indemnity applies only to the extent that the claim arises from your own conduct, and it does not require you to indemnify us for a loss that we have caused. We will tell you promptly about any claim that this section covers and will work with you in good faith to resolve it.
Privacy and personal information
Our handling of personal information, including skin and health related information, is described in our Privacy Policy, which forms part of these terms. Please read it so that you understand what we collect, how we use it and the choices available to you.
By using the website and the services, you confirm that you have read the Privacy Policy and that the information you provide may be handled as described there. Where a client is under eighteen, a parent or guardian confirms acceptance of the Privacy Policy on the younger client behalf.
Third party content and links
The website may include links to websites or services that are run by other companies and organizations, such as a school or a sports club. Those services are governed by their own terms and privacy notices, and AcneAway, Inc. does not control them.
We provide such links for convenience and do not endorse the content of a linked service. If you choose to use a linked service, you do so at your own discretion and subject to the terms of that service, and we are not responsible for its content or its practices.
Suspension and termination
We may suspend or end access to the website or to a service if these terms are breached, if a use places the practice or another client at risk, or if the law requires it. Where a service is ended, we will explain the reason and refund any fee that applies to work not yet performed.
You may end your use of the services at any time by telling us in writing or by telephone. Where a routine ends, we will close the record in an orderly way, explain how a future visit could be arranged and handle the record as described in the Privacy Policy.
Products and home supplies
Some programs include mailed refills of cleansers, kaolin masks, cotton pads and daily sunscreen supplied through partner suppliers. Title in those products passes to you on delivery, and you agree to follow the printed directions that accompany each item. If a supplied item arrives damaged or is missing from your kit, tell the practice within seven days of delivery and the practice will arrange a replacement or an adjustment on your next invoice. Supplies are intended for the personal use of the enrolled client and are not for resale.
The practice may substitute an equivalent item when a listed supply becomes unavailable, and any substitution will match the purpose of the original item. You remain responsible for checking ingredient lists against your own known sensitivities before use, and for storing supplies away from small children and from direct heat.
Governing law and disputes
These terms are governed by the laws of the State of New York in the United States, without regard to conflict of law rules, and the courts of New York have jurisdiction over any dispute that cannot be resolved informally.
If a dispute arises, we ask that you contact us first at help@acneaway.lol or +16625869753 so that we can try to resolve it directly. We will consider any reasonable proposal and will work in good faith toward a fair outcome before any formal step is taken.
Weather and emergency closures
New York weather occasionally closes roads and transit lines. When the practice closes its bench days for weather, power failures or public emergencies, missed visits are rebooked at the next opening without a cancellation charge, and mailed kits are dispatched on the first working day after reopening. The practice updates its voicemail greeting and sends an email notice whenever a closure affects an appointment, and clients who cannot safely travel to a rescheduled visit may request a different day without penalty.
Changes to these terms
We may update these terms from time to time to reflect changes in our practice, in the services we offer or in the law that applies to us. When we make a change, we will revise the effective date at the top of this page and, where the change is significant, we will make the fact of the change clear on the website.
Your continued use of the website or the services after a change takes effect indicates that you accept the updated terms. If you do not agree with a change, you may end your use of the services, and we will handle any active arrangement in an orderly way. We encourage you to review these terms occasionally.
